1. Legal operator
These terms apply to OpenAttention, the creator marketplace product operated under the OpenAttention name.
TODO before launch: add the registered legal entity or sole-trader name, registered address, jurisdiction and legal contact email. Do not treat this placeholder as final legal company data.
2. Accounts and eligibility
You must provide accurate account information and keep your email address, role, profile and contact details current.
Creator, brand and agency accounts may have different access rights. OpenAttention may restrict access if an account is incomplete, misleading, abusive or used outside the marketplace purpose.
3. Marketplace use
Creators are responsible for the accuracy of their public profiles, social handles, portfolio context and contact details.
Brands and agencies are responsible for clear briefs, truthful campaign information, lawful product claims and respectful creator communication.
OpenAttention does not guarantee campaign volume, creator availability, specific revenue, audience growth or business outcomes.
4. Jobs, payments and subscriptions
Brand subscription terms are shown on the pricing and checkout surfaces before purchase. Stripe or another payment processor may handle checkout, invoices and billing portal workflows.
Escrow-style job payments, releases and refunds should follow the actual delivery state of the accepted job. Do not release funds unless the delivered work has been accepted.
Creator accounts are currently intended to be free to join. If that changes, creator-facing pricing must be updated before charging creators.
5. Content, reviews and rights
Creators keep ownership of their original work unless a separate written agreement says otherwise. Usage rights for delivered assets should be agreed in the job brief or an external written agreement.
Reviews should reflect real completed work. Fake reviews, fabricated testimonials and impersonation are not allowed.
Do not upload or share content that infringes intellectual property rights, privacy rights, advertising rules or platform policies.
6. Suspension and termination
OpenAttention may suspend or terminate accounts that misuse the platform, evade payment, harass users, submit false information or create legal or security risk.
Users may request account deletion. Some records may be retained where necessary for payment, tax, fraud prevention, dispute or legal obligations.
7. Legal notes and contact
These terms are a working product baseline and should be reviewed by qualified counsel before broad paid launch.
TODO before launch: add governing law, dispute venue, registered business details and legal contact email.
